1. Acceptance of Terms

By accessing or using the 1960 website and related services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service.

2. Description of Service

1960 is a platform for purchasing, registering, verifying, and managing ownership of limited-edition luxury timepieces. Our services include:

  • Sale of limited-edition watches (500 pieces total)
  • Digital certificate of authenticity issuance and management
  • Ownership registration and verification
  • Secure ownership transfer between verified users
  • Collectors directory and community features

3. Account Registration

To purchase a timepiece or access ownership features, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your account credentials and transfer PIN
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Purchases & Payments

All purchases are subject to the following:

  • Prices are displayed in Nigerian Naira (NGN) and are subject to change without notice prior to purchase completion
  • Applicable taxes (including VAT at the prevailing rate) will be calculated at checkout and displayed before payment
  • Payment is processed securely through Paystack. By completing a purchase, you also agree to Paystack's Terms of Service. We do not store your card information on our servers
  • Payment must be made in full at the time of purchase. You will be redirected to Paystack's secure checkout to complete your transaction
  • All sales are final. Due to the limited-edition nature of our products, we do not offer refunds or exchanges except where required by applicable law or in cases of manufacturing defects
  • Pickup availability timelines are estimates and subject to change
  • Ownership transfer fees, if applicable, are set per watch and do not include VAT

5. Authenticity & Certificates

Each timepiece is issued with a digital certificate of authenticity upon purchase. This certificate:

  • Is uniquely tied to the watch's serial number on the authentication card
  • Is accessible via the authentication card included in the packaging
  • Cannot be duplicated, forged, or transferred independently of the watch
  • Remains linked to the registered owner until ownership is formally transferred through our platform

6. Ownership Transfer

Ownership of a timepiece may be transferred through our platform subject to:

  • Both parties must have verified accounts on the platform
  • The transferring party must authenticate via their secure PIN and OTP verification
  • The receiving party must accept the transfer through their account
  • We are not responsible for private sales or disputes between buyers and sellers outside our platform

We do not facilitate or guarantee any financial transactions between private parties. Ownership transfers on our platform update the authenticity record only.

7. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, designs, and software, is the property of 1960 and is protected by United States and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

8. Prohibited Activities

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any portion of the Service or other systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate any person or entity, or misrepresent your affiliation
  • Create fraudulent accounts or initiate unauthorized ownership transfers
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1960 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim arising out of these terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Product Warranty

Each 1960 Heritage timepiece is covered by a limited manufacturer warranty of two (2) years from the date of original purchase, covering defects in materials and workmanship under normal use. This warranty does not cover damage from misuse, accidents, unauthorized modifications, or normal wear and tear.

12. Indemnification

You agree to indemnify, defend, and hold harmless 1960, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in the English language.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the Service after changes constitutes acceptance. We encourage you to review these Terms periodically.
